Terms of Service for Postion.

Welcome to Postion! We're building a new home for creators, built on the principles of fairness, transparency, and ownership. We're excited to have you join us.

These Terms of Service ("Terms") govern your access to and use of the Postion website, applications, and services ("Services"). Please read these Terms carefully. By creating an account or using our Services, you agree to be bound by them.

1. Your Relationship with Postion

  • You Own Your Content: This is our most important promise. You retain full ownership of all the content, including text, images, and other materials you create and post on Postion ("Your Content"). We will never claim ownership of your work. You simply grant us a license to display, distribute, and promote it as part of our Services.
  • You Control Your Data: You own your subscriber list and user data. We provide tools for you to manage and export your data, empowering you with true content autonomy.
  • Age Requirement: You must be at least 13 years old to use our Services. If you are under 18, you must have your parent or legal guardian's permission.

2. Your Responsibilities as a Creator

  • Be Lawful and Respectful: You are responsible for Your Content. You agree not to post anything that is illegal, defamatory, harassing, hateful, or infringes on anyone's intellectual property rights (like copyright or trademark).
  • Accurate Information: You agree to provide accurate information when creating your account. You are responsible for the security of your account and password.
  • Monetization Compliance: When using our monetization features (subscriptions, ads, sponsorships, etc.), you agree to comply with all applicable laws and regulations, including tax obligations. You also agree to be transparent with your audience about any sponsored content.

3. Postion's Services and Our Rights

  • License to Host and Display: By posting content, you grant Postion a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute Your Content on and through our Services. This is solely for the purpose of operating, promoting, and improving Postion. This license ends when you delete Your Content or your account.
  • Content Distribution: When you use our multi-platform distribution feature, you authorize us to share Your Content on your behalf to the platforms you connect. You are still subject to the terms of those third-party platforms.
  • AI-Powered Features: Our AI features (writing assistant, search, summarization) are provided to enhance your experience.
    • Your Content may be used to train AI models exclusively for your own site's search and recommendation features.
    • We will never use your private content to train general-purpose AI models without your explicit, opt-in consent.
  • Community Features: Our community is built on trust. We reserve the right to remove content or suspend accounts that violate our community guidelines or these Terms. As a "co-builder," your feedback on our Roadmap is valued, but final decisions on platform features rest with Postion.
  • Changes to Services: We are constantly improving Postion. We may add, change, or remove features at any time. We will provide notice of significant changes where feasible.

4. Monetization and Fees

  • Revenue Share: We believe in a fair partnership. Our fee structure is transparent. For subscription revenue, Postion takes a 5% platform fee, plus any standard processing fees from our payment partners (e.g., Stripe).
  • Early Creator Benefits: As outlined in our promotional materials, early creators may be eligible for reduced or waived fees for a limited time. These benefits are subject to change and will be clearly communicated.
  • Payouts: You are responsible for connecting a valid payment account (e.g., Stripe) to receive your earnings. Payouts will be processed according to the schedule set by our payment processor.

5. Termination

  • By You: You are free to leave at any time. You can delete your account and export your content and subscriber data from your dashboard.
  • By Us: We may suspend or terminate your account if you materially breach these Terms. We will make a reasonable effort to notify you and allow you to remedy the breach where appropriate.

6. Disclaimers and Limitation of Liability

  • "As Is" Service: Our Services are provided "as is" without any warranties, express or implied.
  • Limitation of Liability: To the fullest extent permitted by law, Postion shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

7. Governing Law

These Terms shall be governed by the laws of [the State of Delaware, USA], without regard to its conflict of law provisions.

8. Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted on our website. If a revision is material, we will notify you via email or a notice on the platform. By continuing to use the Services after revisions become effective, you agree to be bound by the revised Terms.
